any advice - poss bankruptcy debt help

Hi,

I am 29 years and have a loving husband and a little boy. I got into debt a few years ago mainly due to family problems, breakdown of a relationship and earning less money then my friends and trying to keep up!!

I started an iva and was okay with that until i had my little boy and i had to be part time. I couldn't keep up the payments so my iva failed. Since then i had creditors contacting me again. And have got very depressed. On top of that i have had family problems again and a miscarriage and basically a stressful time. To which i went out and spent money on clothes, books, going out etc. Thinking it would all go away.

Obviously it didn't and i did the worst thing ever and took a loan out in my husbands name. To which he found out. He, although cross has supported me to go to citizens advice and the doctors. The doctor has told me to find a group in my area. Does anyone know any debt groups in the hampshire area?

Also my main concern is that citizens advice have advised me to go bankrupt with my failed iva, which amounts to £43,000. The thing i want to know is, will my husband keep the house. He put a big deposit down and the house is in his name. I pay towards the bills. I was told by a bankruptcy place that as long as he can prove that the house is his etc, that even though i live there it would be ok as its his asset and not mine. And i was just wondering if anyone knew that to be true??

I have thought about ending it all but my little boy is enough to not. So have been giving anti depressants today and feel that now i have realised there is a problem that maybe there is light at the end of the tunnel!!!!

With an iva you should be able to reduce your payments and stretch the time out longer. It may take more years to pay a reduced amount, but go back to the people who first set it up for you and explain your change of circumstances. You should be able to avoid going bankrupt with an extention to your iva. They will take your present outgoings into consideration, you will need to write it all down on their forms, please go back and discuss this option before deciding. If necessary see a solicitor. When you changed from full to part time working there should have been a new assessment made for your change of circumstances. Don't give up, good luck.

Hi Molly, speak to the CCCS, they are a voluntary group who help all sorts of people in debt. i am 24k in debt and am on debt management plan due to a number of bad business deals, they deal with all creditors and will advise you the best option. They have all the information you need, they have a website http://www.cccs.co.uk/.
